General Terms and Conditions to walk with Luis

1. Scope of application

These General Terms and Conditions (hereinafter referred to as T&C) apply to all contracts between walk with Luis (Luis Miguel Kann, hereinafter referred to as WWL) and the contractual partner/s (hereinafter referred to as customer/s or participant/s).

 

2. Formation of the contract

The contract between WWL and the customer/s is concluded by the confirmation E-Mail and the money transfer of the tour price which varies depending on the number of people attending. The constumer with whom the contract is made has to be of full age according to German law (at least 18 years old). At least one participant in the group has to be of full age and assume responsibility for underage participants. The regular price for the tours applies to participants from 12 years of age. Participants between ages 7 and 11 will be charged 50% of the additional cost per person. Children under 7 can participate free of charge.

 

3. Cancellation by walk with Luis

WWL has the right to withdraw from the contract and cancel the event, e.g., in the event of force majeure, illness or special circumstances on site. If an event has to be cancelled, the tour price already paid will be 100% refunded or an alternative date will be offered.

 

4. Modifying the number of participants, Rebooking or Cancellation by the Customer

Modifying the number of participants is generally possible anytime before the event via Email, message or phone call. The cost difference will be settled by money transfer or in cash. If the total number of participants surpasses 5, WWL reserves the right to reject this as it is conflicting with the concept.

In any case still at least one participant has to be of full age and assume responsibility for underage participants.

Rebooking is possible up to 24 hours before the event date, subject to the availability.

Cancellation by the costumer is possible via Email under the following conditions:

a) Booking cancellation up to 48 hours before the scheduled start of the event, 100% refund of the ticket price.

b) Booking cancellation up to 24 hours before the scheduled start of the event, 50% refund of the ticket price.

c) Booking cancellation within 24 hours before the scheduled start of the event, 20% refund of the ticket price.

In case of a delay by the participant/s of more than 15 minutes WWL will provide a reduced version of the walking tour.

In case of a delay by the participant/s of more than 30 minutes the tour will be cancelled and no refund will be made.

 

5. Changes to the program

WWL reserves the right to change the program and routes of the walks according to the group’s needs/interests or force majeure and/or other special circumstances on site.

 

6. Disclaimer

Participation in a WWL walk is at the participant’s own risk. Parents are liable for their children. Pet owners are liable for their pets.

WWL accepts no liability for accidents.

Excluded from this exclusion of liability are damages caused by grossly negligent breach of duty by the guide.

 

7. Exclusion of Participants

By coming on a WWL walk participants agree to behave respectfully towards the places we visit as well as their residents and to treat any historical sites and monuments with care and to follow the instructions of the guide at all times.

WWL reserves the right to refuse service to participants who:

-permanently disrupt the course of the tour.

-show up in an intoxicated and/or drugged up state.

-endanger themselves or other persons through their behaviour in any way.

-behave disrespectfully towards the guide or the places we walk through.

-make any sort of statement or gesture which is discriminatory, misogynous, racist, anti-constitutional or disrespectful of religious beliefs or sexual orientation or any other offensive gesture.

In any of the above cases there will be no refund.

 

8. Dispute resolution

Consumers have the possibility to use this platform for the settlement of their disputes.

I am not willing or obliged to participate in dispute resolution proceedings in front of a consumer arbitration board.

 

9. Changes

WWL reserves the right to change the offer and the terms of use at any time without giving reasons. Changes will be announced by appropriate means.

 

10. Severability clause

Should any provision of these T&Cs be invalid or violate applicable German law, it shall be replaced by a valid or enforceable provision that comes closest to the legal intent of the invalid provision.
